EU €3 Customs Duty: Per Parcel or Per Item? The Answer Nobody Explains

If you've heard about the new €3 EU customs duty, you've probably seen conflicting information: "It's €3 per parcel!" "No, it's €3 per item!" "Wait, it's per HS code?" Nobody seems to agree. And getting this wrong means you either overcharge your customers (and lose sales) or undercharge yourself (and lose money).

This matters for anyone doing cross-border ecommerce — whether you're on Shopify, eBay, or your own store. The EU de minimis reform (Council Regulation (EU) 2026/382) eliminated the €150 duty-free threshold, and now every low-value parcel owes import duties and customs fees.

Let me settle this once and for all.

The short answer

The €3 fee is charged per customs declaration line, not per parcel.

And a declaration line is defined by three things:

  1. The HS code (first 6 digits = HS6) — look it up with a tariff code checker
  2. The customs description
  3. The country of origin

If multiple products share all three, they count as one line = €3. If they differ on any of the three, they count as separate lines = €3 each.

Let's break it down with examples

Example 1: same product, different colors

You sell 5 t-shirts to a German customer — all cotton, all same design, different colors. HS code: 6109.10 (identical), description: "Cotton t-shirt" (identical), origin: China (identical). Result: 1 line = €3.

Example 2: different products, same HS6

You sell 3 cotton t-shirts + 2 cotton tank tops. Both have HS 6109.10, both are "cotton tops", origin China. Result: 1 line = €3. Both are cotton apparel under the same HS6 code — you can legally group them.

Example 3: different materials

2 cotton t-shirts (HS 6109.10) + 2 polyester t-shirts (HS 6109.90). Result: 2 lines = €6. Different HS6 codes = different lines. You can't group these.

Example 4: different origins

3 products made in China + 1 made in Vietnam. Same HS code, same description, but different origin. Result: 2 lines = €6.

So how much is it actually?

The difference between 1 line and 20 lines is €57 per order. At 10 orders per day, that's €17,100 per month. Whether you're charged €3 once or 20 times per shipment is entirely in your control — see how HS6 grouping changes the math.

Why does everyone confuse this?

Because the regulation uses the term "customs item," and different people interpret it differently:

  • Carriers say "per parcel" because they simplify for customers
  • Customs brokers say "per declaration line" because that's how it works
  • Sellers Google and get confused because both answers exist

The official guidance from the EU Commission is clear: the payable amount = number of declaration lines × €3.

What this means for your store

Good news: you're not being charged €3 per product — you pay €3 per unique HS6 code. Bad news: most sellers overpay. Without optimization, sellers list every product as a separate line — a 20-product order becomes 20 lines = €60. With HS6 grouping, the same order might be 4 lines = €12.

Can you actually group products?

Yes, and it's completely legal. The HS system was designed with 6-digit international codes specifically so products in the same category can be declared together. This is not a loophole — it's the intended way customs declarations work.

  • ✅ Same HS6 code
  • ✅ Same country of origin
  • ✅ Same product description
  • ❌ Don't group different HS6 codes
  • ❌ Don't group different origins
  • ❌ Don't fake descriptions

How this relates to IOSS

If you're using IOSS to collect VAT at checkout, note that IOSS handles VAT only — it does not cover the €3 per-line customs duty. You still owe €3 per declaration line regardless of IOSS status. The sellers who optimize both IOSS (for VAT collection) and HS6 grouping (for line fees) save the most — see the full IOSS guide for Shopify sellers.

DutyRight shows you exactly how many unique HS6 codes your store has and how many declaration lines you could reduce — saving you €3 per line on every shipment. It's currently under Shopify review — join the waitlist for the install link and early-bird discount.
